Terms and Conditions of Sale

These Terms and Conditions of Sale (“Conditions”) govern the purchase of a ticket for admission to Thermëa by Nordik Spa-Nature. These Conditions constitute an agreement between you and Nordik Immobiliers – Winnipeg Inc., 12312476 Canada Inc. and/or Gestion Nordik & Spa Nature Inc. (“Thermëa by Nordik Spa-Nature”). By purchasing a ticket for admission to Thermëa by Nordik Spa-Nature through its website or by telephone, you are agreeing to these Conditions.

Prices displayed

Thermëa by Nordik Spa-Nature invoices in Canadian currency. All prices listed, unless otherwise stated, are shown in Canadian dollars (CAD) before taxes. Rates are subject to change without notice.

Thermëa by Nordik Spa-Nature reserves the right at any time to modify or discontinue any service (or any portion or content of any service) without notice and at any time. We will not be liable to you or any third party for any change in price, suspension or discontinuation of service.

Guarantee & pre-authorization

A valid credit card must be used to guarantee your reservation at Thermëa by Nordik Spa-Nature. Thermëa by Nordik Spa-Nature reserves the right to cancel any reservation made with an invalid credit card. On the day of a booking, Thermëa by Nordik Spa-Nature requires you to present a valid credit card for the purposes of placing a $150 pre-authorization charge on it per guest. Upon arrival at Thermëa by Nordik Spa-Nature, you will be issued a unique RFID bracelet to be used by you to make purchases during your visit to Thermëa by Nordik Spa-Nature. At the conclusion of your visit, the $150 pre-authorization will be adjusted automatically to take into account the purchases made on your RFID bracelet during your visit and you will be charged for the actual amount spent.  If your $150 pre-authorization is reached during your visit, another pre-authorization for the same amount will be processed automatically on the same credit card.

Cancellation policy

Cancellations must be requested by email. Please keep in mind that:

• Reservations remain fully refundable to the original method of payment if cancelled at least 48h before the reservation time.
• Cancellations made between 24h and 48h prior will be entitled to a full reservation credit in the form of a gift certificate that will be sent to the email address used for booking. The credit may then be applied to a future reservation. It is also possible to postpone a reservation to another date up to 24h before the original arrival time.

Should you need to postpone or modify a reservation with less than a 24h notice, it may be requested by phone (9 a.m. to 5 p.m. CST) or via chat (9 a.m. to 7 p.m. CST) and will incur a rebooking fee.

Force Majeure

Thermëa by Nordik Spa-Nature will not be responsible for any delay or failure to perform its obligations under these Conditions or otherwise, which arise out of or is due to unforeseeable events independent of the intention of the parties such as but not limited to force majeur (“Force Majeur Events”), including, by way of example and not of limitation, all events of war, terrorist actions, interventions and prohibitions of official authorities, delays, inclement weather, lack of energy, financial crisis, labour conflicts, epidemics and pandemics.

Liability Limitation

All guests of Thermëa by Nordik Spa-Nature are required to sign a liability waiver releasing Thermëa by Nordik Spa-Nature for any loss, damage, accident, illness and other items as specified therein upon arrival at Thermëa by Nordik Spa-Nature. Any guest who declines to sign the liability waiver will be denied entry without refund or compensation.

Confidentiality

Thermëa by Nordik Spa-Nature is concerned about the privacy of its guests and undertakes to respect it. This policy has been formulated to inform all guests of Thermëa by Nordik Spa-Nature of its firm commitment to this effect. No personal information is collected or disclosed unless the prior consent of the user has been obtained voluntarily by writing directly to an email address mentioned on our website, participating in a promotion, registering for a service, creating a profile, or in any other similar way.

Conformity

In order to safely provide guests with the requested services, Thermëa by Nordik Spa-Nature reserves the right to ask its guests to provide personal information or supporting documents if and when necessary.

Electronic tickets and resale

Illegal resale of any ticket of admission is strictly prohibited and can result in the cancellation of the purchase without refund or compensation. Admission tickets are not transferable nor exchangeable for money and are only valid for the date and time selected during the booking process.

Promotional use prohibited without permission

Without prior written authorization from Thermëa by Nordik Spa-Nature, admission tickets cannot be sold or used for advertising and/or promotional purposes (including contests and lotteries).

Photographs & social content

Photographs, films or social media of any kind content taken at Thermëa by Nordik Spa-Nature cannot be used for any commercial purposes without prior official written consent from Thermëa by Nordik Spa-Nature. Thermëa by Nordik Spa-Nature reserves the right to seek compensation for any use which is contrary to these Conditions.

Eligibility

You must be at least 16 years of age to access Thermëa by Nordik Spa-Nature. All guests of Thermëa by Nordik Spa-Nature must present a valid piece of government issued identification for admission. All guests are required to sign a liability waiver releasing Thermëa by Nordik Spa-Nature upon arrival at Thermëa by Nordik Spa-Nature. Any guest who declines to sign the liability waiver will be denied entry without refund or compensation.

The thermal experience is not recommended for people with heart problems, hypertension, breathing problems, angina, high-risk pregnancy or diabetes.

Guests of Thermëa by Nordik Spa-Nature are strictly prohibited from bringing in, or consuming, outside food, alcohol, or illegal substances. To ensure the safety and wellbeing of Thermëa by Nordik Spa-Nature guests, the consumption of any forms of tobacco or cannabis are prohibited at Thermëa by Nordik Spa-Nature.

Thermëa by Nordik Spa-Nature reserves the right to inspect the bags and/or lockers of its visitors.

Refusal of access & expulsion

Thermëa by Nordik Spa-Nature reserves the right to refuse access or expel any guest whom it considers is acting against its code of ethics, values, or behavioural etiquette. Interactions  at Thermëa by Nordik Spa-Nature, including Thermëa by Nordik Spa-Nature social media platforms/sites, must be carried out in a respectful, harmonious, and courteous manner. Insulting, threatening, or harassing another guest or employee is prohibited. Thermëa by Nordik Spa-Nature maintains a zero tolerance policy with respect to , defamatory, indecent, hateful, racist, xenophobic, homophobic, sexist, vulgar, or discourteous statements or any other violent act.

Modification of Conditions

Thermëa by Nordik Spa-Nature reserves the right to modify these Conditions and its cancellation policy at any time. The last revision of these Conditions is displayed at the bottom of this page.

You expressly request that these conditions and any other document or communication related thereto be drafted in English only. Please note they are also available in French.
